This also includes our Privacy Policy, Deliveries, Cancellations and refunds and Returns Policy.

We reserve the right to amend and update these terms and conditions at any time. Any changes that are made will take effect when the updated terms and conditions are uploaded onto our website with the amended date at the top right of the page. It is your responsibility to read the terms and conditions each time you use the website to make a purchase and your continued use of our website shall signify your acceptance to be bound by the latest terms and conditions.

Do South Ltd has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT unless stated otherwise, and where applicable. For a VAT receipt please email us at info@do- south.com. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colours will accurately reflect the colours of the product on delivery.

The Sales Process Payment We take payment from your card at the time we receive your order once we have checked your card details. Deposits Payments If a deposit has been paid at point of sale the full outstanding balance will be due to be settled two weeks prior to delivery. Deposits will not be refunded if you choose to cancel your order. Fraud checks may be conducted on our orders. This involves checks on details provided during the order process including the address details. This may involve your details being passed to a 3rd party fraud checking company. process your order. We will conduct this process as quickly as possible however on occasion dispatch of goods may be delayed.

The price you pay is the price displayed on this website at the time we receive your order and the payment process is complete. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option to either reconfirm your order at the correct price or cancel it. If we are unable to contact you following a reasonable number of attempts, we will treat the order as cancelled and where payment was received for the goods, you will receive a full refund.

Title to any products you order on this website shall pass to you on delivery of the products, provided that we have processed and received payment in full for the products.

All prices include VAT (where applicable) at the applicable current rates but exclude delivery charges unless expressly stated otherwise.

All credit card transactions are taken in the UK and our transaction currency is in UK Pounds (£).

Vouchers

Voucher offers are valid for the length of time stated on the voucher from the date of issue. Only one voucher per customer may be used. Cannot be used in conjunction with any other offer or discount.

Gift Wrapping

A gift wrapping service will be available on certain items, please email info@do-south.com for further information.

Warranties

All our products are manufactured to the highest quality. Please contact our sales or customer service team for further information on individual products manufactures warranty on info@do- south.com. All products are warranted against manufacturing defects, except for all moving parts (mechanisms, castors, drawers) and seating upholstery which are subject to usage related wear and tear.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. A full refund will be given where payment of these goods has already been received.

Ordering Errors

You can correct errors on your order up to the point at which you click on “submit” or “make payment” on the final page of our ordering process.

Click and Collect

Click and Collect orders are accepted and orders may be picked up from the shop within normal

opening hours unless stated otherwise. You will be notified when your goods are ready to collect.

Acknowledgment and Acceptance of your Order

If you have supplied us with your email address, we will notify you by email as soon as possible to acknowledge your order. Please note that this e-mail is not an order confirmation or order acceptance from Do South Ltd. Our acceptance of your order will take place upon dispatch of the product(s) ordered.

Delivery

Delivery of orders

Delivery charges vary depending on the type of products ordered and the service you select All delivery charges are non-refundable. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors and all goods and products are subject to availability. We will do our best to get all orders dispatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. You have the right to cancel delayed orders at any time and get a refund prior to the item being dispatched. Once your goods have been dispatched you cannot cancel the order you will need to follow the Returns Policy (please refer to the Returns Policy).

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.

If you are purchasing to replace your existing furniture, we recommend that you do not dispose of your existing furniture until your new goods have arrived and you have checked for damages. For large items of furniture i.e. Sofas and Dining Tables, the customer will be contacted by our delivery team to book a delivery time. Please note we are not responsible for moving or disposing of your existing furniture.

It is the customer’s responsibility to ensure that there is proper access at the delivery address. We suggest measuring all doorways, staircases, lifts and access areas, as well as the area where the order will be positioned.

Delivery hours are Monday to Friday between 9.00am and 6pm.

If the customer requires a change of delivery address, they should contact Do South Ltd in writing via email at info@do-south.com this must take place at least 4 weeks prior to the expected delivery date of their delivery date. It is the customer’s responsibility to pay the delivery cost for items that need to be returned to Do South due to a claim, exchange or refund. Goods that cannot be received by the customer once it has arrived in store may be subject to a warehousing charge of £15.00 per day.

Lead Times

Our suppliers have set lead times, but if for any reason there is a delay in the shipping of orders, we will contact the customer either by telephone or email.

Missing items
On delivery:
Should an item be missed or appear not delivered then we request that you notify us as soon as possible, preferably within 24hrs of initial receipt of your delivery.
On assembly: Should a part appear missing from an item please report the item that is missing the part along with a description of part you believe to be missing. On both the above instances replacement goods will be dispatched as soon as reasonably.

Faulty goods
Damages:
must be reported as soon as is reasonable after the delivery, preferably within 24hrs of receipt of goods.
Under Warranty: report the fault to us with a full description of the alleged fault, we will then arrange an engineer to attend and either rectify the fault on site or advise on action required to remedy. If the fault is deemed a manufactures fault and the item is under warranty, then we will arrange the replacement of the faulty item free of charge.
Not Under Warranty: report the fault to us with a full description of the alleged fault, we will then arrange an engineer to attend and either rectify the fault on site or advise on action required to remedy. Please Note: You as a customer are liable for the cost of the engineer call out charges and any parts or repairs.

Export Restrictions

We will specify any export restrictions that apply on any of our products on individual product listings. Any export restrictions will also be clearly indicated at checkout.

Returns Cancellations and Refunds

Bespoke orders

Orders of bespoke pieces are not be able to be refunded or exchanged. Once a bespoke order has been processed following the 7-day cooling off period the item is non-refundable and you are liable for full payment for the cost of the item and delivery charges.

Order amendments or cancellation

Please contact us in writing via email at info@do-south.com with your amendment or cancellation details. If your order has not yet been received, then this will be possible free of charge. If you have received the order and you wish to amend or cancel the goods, a charge will be applied based upon the direct cost to recover and/or redeliver the goods. We request that changed / cancelled items are returned in their original packaging.

Returns and refunds

Damaged goods must be reported as soon as is reasonably possible following delivery, preferably within 72 hours of receipt of goods. Contact us with a full description and photographs of the fault via email to info@do-south.com . We will contact you to arrange repair, replacement or refund of your damaged items provided or if a valid warranty period applies.

For reasons of hygiene we cannot refund or exchange opened mattresses or mattress toppers

unless they are faulty. You should therefore inspect and test your mattress before removing the

packaging. Some mattresses arrive vacuum packed, please do not open and unroll to inspect if the goods are incorrect. There will be clear identification seen through the packaging.

Unwanted items must be returned unused and in a saleable condition and packaged in their original packaging or packaging of equivalent quality.
When returning items please allow 10-14 days from the date of collection for your refund to be processed. We will send you an email to let you know when your refund has been processed. Refunds will be credited by your original method of payment.

Our Liability to You

Our website is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the internet.
We (including our parent, subsidiaries, affiliates, directors, agents and employees) shall not be liable to you in contract, tort (including negligence) or otherwise for:

1)  Losses that were not caused by any breach on our part; or

2)  Any loss of business, revenue, profits, contracts, anticipated savings, data, goodwill or wasted expenditure); or

3)  Any damage to property; or

4)  Any third-party claims; or

5)  Any indirect or consequential losses or expenses; or

6)  Any losses that were not reasonably foreseeable to both you and us when you commenced using our services.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.
Regardless of the previous paragraphs, if we are found to be liable, our liability to you or to any third party is limited to any amounts paid by you to us (including original postage costs) for the goods or order which gave rise to the liability.
The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights. For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.
Nothing in these terms and conditions shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.

Severability

Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.
